| Distributing the facts on 457 |

In
September 2007, the Department of Immigration and Citizenship (DIC)
sent all employers under the 457 visa program a letter enclosing a list
of frequently asked questions (FAQ).Employers have an
obligation to distribute this FAQ list to their sponsored employees
within five business days of receipt and provide the list to new
sponsored employees on commencement of employment. The purpose of the FAQ list is to increase awareness and understanding of various aspects of employees’ 457 visa including cancellation, changing sponsors, medical costs, accommodation, minimum hours, minimum salary, and superannuation. If an employer fails to distribute the list, DIC will regard this as a failure to comply with its obligations as an approved business sponsor and this could result in significant penalties. These penalties could lead to cancellation of the sponsorship or other sanctions under the sponsorship program including, the receipt of a notice of noncompliance, an audit of the employers business by DIC or a bar placed on future sponsorship applications.
