Amendments to the Building Act

New Obligations for Building Owners

The Building Act 1975 now requires owners of commercial buildings to conspicuously display the certificate of classification for the building at the building's main entrance.  The obligation applies to all certificates of classification given for a building on or after 1 July 1997.  Transitional provisions in the Act mean that for certificates of classification which issued after 1 July 1997 but before commencement of the amending section (23 April 2008) the obligation to display the certificate of classification does not commence until one year's time.  All owners of commercial buildings should take steps now to locate the certificates of classification.  If the certificate cannot be located, application can be made to the local authority for a copy of the certificate of classification to ensure compliance with the statutory obligations in April 2009.
