Experience

Jeanenne Wilkinson has over 13 years experience in dispute resolution covering a broad range of issues from insurance to defamation, professional negligence and construction. Jeanenne has worked in a number of jurisdictions for government, corporate and individual clients. 

Insurance 

Providing advice on indemnity to insureds regarding policies of insurance covering directors and officeholders for defamation and breaches of Trade Practices Act 1974 (Clth) (misleading and deceptive conduct) and acting in proceedings.

Providing advice to publishers and broadcasters regarding publication (including statutory restrictions), available defences and dealing with post publication complaints and any resulting defamation litigation.

Providing general advice regarding defamation including seeking publication of clarifications and apologies and resolving claims without recourse to litigation.

Providing advice regarding the application of the Queensland Building Services Authority's statutory insurance scheme. 

Defended council against a $3m personal injury claim (quadriplegic), limiting issues to liability.

Acting for national insurer in $1m water skiing accident claim including obtaining detailed proofs of evidence and advice regarding reliance on form of waiver/ indemnity executed by participant.

Acting for national insurer in a property damage claim at a building site. Settled with subcontractor's insurer meeting 50% of claim.

Defending product liability claims including, claims against the European manufacturer of equipment in respect of allegations of defective design.

Commercial Litigation

Considering unauthorised use of trade marks and use of "get up" such as to constitute passing off. Providing strategic advice and taking action necessary to enforce client's IP rights.

Providing pre publication legal checking and advice to publishers to reduce the risk of defamation proceedings and breaches of the Trade Practices Act 1974 (Cth) including providing strategic advice on how to minimise the risk of litigation.

Acting for developers and corporate clients in contractual disputes including managing litigation seeking specific performance to enforce contracts for sale of residential property and seeking declaratory relief to recover forfeit deposits.

Appearing as an advocate in the Magistrates Court, District Court and Supreme Court arguing interlocutory applications as and when required during the conduct of simple and complex litigation for example, seeking to vary orders, disputes regarding disclosure of documents, and seeking to strike out claims.

Acting for clients in the health services and aged care industry providing advice regarding a wide range of issues including employment, Privacy Act 1988 (Cth)obligations, obligations under the Health Act 1937 (Q), defamation and dispute resolution.

Conducting a wide-range of litigious matters through all stages of litigation including preparation and instructing counsel at trial including proofing witnesses and all aspects of preparation for example claims in tort, contract, defamation and breaches of the Trade Practices Act 1974 (Cth).
