| BCIPA Decisions to be Final |
Macrossans Lawyers Monitor - Autumn 2006Since our last issue, the Judicial Review Act has been amended, so that an adjudicator's decision under the Building & Construction Industry Payments Act (BCIPA) is exempt from review. This means that an adjudicator's decision is more likely to be final, enabling prompt resolution of account disputes for the building and construction industry. The amendments will take place in May or June of this year and are unlikely to be retrospective. To date, the Supreme Court has been reluctant to overturn any adjudicator's decisions that have been challenged; however, there are various appeals pending. This developing area of the law will be watched with interest by many in the construction industry.
