In May, Macrossans Partner, Robin Lonergan spoke at the Inter Pacific Bar Association conference in Sydney on how Australian companies can now tender for government work in the US under the Australia / United States (US) Free Trade Agreement (FTA). 

Australian companies can tender for contracts with the US Federal Government and 28 of the US States including California, New York, Florida, Pennsylvania, Texas and Michigan.  All tenders must be non discriminatory and the US has agreed to waive the 6 per cent penalty under the Buy America Act.

Thresholds exclude Australian companies from tendering for contracts of less than $81,000 (Federal level) and for construction contracts less than $10,000,000 (Federal level).  US companies have similar restrictions on tendering in Australia.
